This Acceptable Use Policy specifies the actions prohibited by Visual Perspectives Internet, Inc. ("VPI.Net") to users of the VPI.Net Network and VPI.Net Services. VPI.Net reserves the right to modify the Policy at any time, effective upon posting of the modified Policy. All clients are required to follow the guidelines of their contracts and this acceptable use policy.Last updated 1/1/2005.
The VPI.Net Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
Violations of system or network security are prohibited, and may result in criminal and civil liability. VPI.Net will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:
Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network. Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP/IP packet header or any part of the header information in an email or a newsgroup posting.
Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site.
Prepayment of services are non-refundable.
Transmitting or relaying of unsolicited email via VPI.Net, any of VPI.Net's servers, or network is strictly prohibited. Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting, also known as "SPAM") is explicitly prohibited.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A VPI.NET CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

Hosting services are all secured, shared servers unless a seperate dedicated services contract is signed. Hosting services that are shared are subject to bandwidth guidelines where one hosting account cannot compromise nor slow down the services for other clients on the shared server.
VPI.Net offers a wide variety of hosting services for clients from shared, non-enterprise hosting services from $19.95 per month up to enterprise hosting farm with maximum availability services from $75/mb. up to 1200 Mbps. and dedicated server farm rental services (mutiple available servers clustering for load balancing) from $500/mo. per server.
VPI.Net offers a wide variety of SQL servers for hosting clients included at no additional charge. For client and consumer security shared servers do not have mySQL administration access or raw tool access for security purposes. If you require a custom administration tool and access, please contact your VPI.Net sales representative whom will provide you a quote on the hosting fees for this custom tool.
Termination or modification of services will go in to affect at the end of the current billing cycle. VPI.Net can elect to terminate services at anytime. Any termination or modification of services require the account to be current without any outstanding invoices, bills, or payment plans on contracts or services rendered.
VPI.Net cannot and does not capture Websites on behalf of clients. VPI.Net will assist you in properly FTPing your Website on to the VPI.Net web servers.
Accounts must be current to have access to your Website, content management software, FTP and full access to your Website.
Websites, web servers and the Internet continue to evolve. VPI.Net cannot make any warranties of service that scripts or services will continue to function after required updates to services. VPI.Net has and will continue to make efforts to support and continue to provide service for legacy systems. Certain issues beyond VPI.Net control make result in particular services not being able to be provided. Web browsers and Web browser versions may affect the way your Website is displayed. It is recommended that you and your audience operate with the most current versions of Web browsers.
Customer hold the Provider harmless against all claims, suits, costs, damages, judgments, loss of revenue, loss of business, attorney's fees, settlements or expenses incurred, claimed, obtained or sustained including third parties, whatever the cause of action including, without limitation, defamation, misappropriation, invasion of privacy, intellectual property infringement, or otherwise, whether such claims are meritorious or not, with regard to said customer Website, said email, other Internet related services. Customer must use programs that are supported by VPI.Net for VPI.Net to provide support. If VPI.Net is not your access provider and you are experiencing difficulties, VPI.Net may not be able to resolve issues for you.
The Customer shall indemnify and hold harmless Provider from any and all loss, cost, expense, and damage on account of any and all manner of claims, demands, actions, suits, proceedings, judgements, costs and expenses that may be initiated against Provider and Provider's officers, directors, and employees for any service provided to Customer by Provider to include web space content that violates any copyright, proprietary right of any person, state and federal regulations, or contains any matter that is libelous or scandalous.
Partners must maintain a minimum of 25 active accounts for partner priveledges and rates unless otherwise noted in writing by Visual Perspectives Internet, Inc.
The VPI.Net billing department requires cancelation notices to be provided in writing either via fax transmission or via mail unless otherwise stated. Cancelations go into effect at the end of the current billing cycle. All accounts must be current prior to termination of services.
Domain names are subject to availability. Domain names are the responsiblity of the domain name holder. VPI.Net does not assume responsiblity for domain names. Domain name monitoring services require a separate domain name monitoring agreement. It is the responsibility of the client to renew their domain name.
VPI.Net reserves the right to refuse service to anyone at anytime.
The currently VPI.Net hourly rate is $165 per hour. Effective January 22,2007.
All sweepstakes entries are stored securely for one year then destroyed.
